Terms & Conditions

These terms govern your use of the smartbmsutility.com website and, where applicable, the SmartBMS Utility app published by Kühner & Gehrke Development UG (haftungsbeschränkt) ("we", "us").

The app itself is purchased and downloaded through the Apple App Store, Google Play, or Microsoft Store. The purchase transaction, payment, and refund process are governed by that store's own terms of service, not by an agreement directly between you and us.

Subject to the terms of the app store you purchased through, we grant you a non-exclusive, non-transferable license to use SmartBMS Utility for your own personal or business purposes, on devices you own or control.

The app, its source code, design, and documentation remain the property of Kühner & Gehrke Development UG (haftungsbeschränkt) and are protected by copyright. This license does not grant you any right to redistribute, resell, or reverse-engineer the app beyond what's permitted by mandatory law.

SmartBMS Utility is a monitoring and configuration tool for Battery Management Systems. It is not a substitute for following your battery and BMS manufacturer's own safety instructions, proper installation, or professional judgment.

You remain solely responsible for the safe operation, installation, and configuration of your battery system. Changes you make through the app's configuration features (charge/discharge limits, protection thresholds, and similar settings) take effect on your hardware — review them carefully before applying.

We are liable without limitation for damages caused intentionally or through gross negligence, and for injury to life, body, or health, as required by German law.

For all other cases, our liability is limited to foreseeable damages typical for this kind of app, and excluded for ordinary negligence to the extent permitted by law. We are not liable for damage to battery hardware arising from configuration values you entered yourself, from third-party BMS hardware defects, or from use of the app in a way inconsistent with your BMS manufacturer's instructions.

Your statutory warranty rights are unaffected by these terms. Refund requests for your app purchase should go through the app store you purchased from, in line with that store's refund policy.

We may update these terms as the app or website changes. The version in effect at the time you use the site or app applies.

These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If any provision is found invalid, the remaining provisions stay in effect.
